CyberCluster legal information

Terms of Service, Privacy Policy, and Refund Policy

This page explains the terms that govern your use of CyberCluster, including purchases of digital datasets and custom data services.

Terms of Service

By accessing this website or purchasing any CyberCluster product or service, you agree to these Terms of Service. If you do not agree, you must not use this website or purchase our products.

1. Scope of service

CyberCluster provides structured digital datasets, sample previews, and custom research or data delivery services relating to ecommerce stores and advertising-related technical signals. The website content, product pages, checkout pages, and any approved custom order description form part of the commercial description of what is being sold.

2. Use license

Permission is granted to purchase and use CyberCluster datasets and deliverables for lawful internal business use only. This is a license, not a transfer of title.

  • You may use the purchased data for internal prospecting, research, lead qualification, analytics, or similar business workflows, subject to applicable law.
  • You may not resell the data, resell access to the data, sublicense it, republish it, or distribute it to third parties unless we have given written permission.
  • You may not claim CyberCluster data as your own proprietary dataset.
  • You may not remove copyright, proprietary, or attribution notices where they are present.
  • You may not copy the website structure, product presentation, or supporting materials for competitive cloning purposes.
  • You may not use the data or website in any unlawful, fraudulent, deceptive, harmful, or abusive manner.
  • You may not use our website or deliverables to send spam, mass unsolicited commercial email, or conduct unlawful outreach.
  • You may not attempt to gain unauthorized access to any part of the website, hosting stack, payment flow, or connected systems.

3. No account or subscription assumption

Unless explicitly stated otherwise on the relevant product page or checkout page, CyberCluster products are sold as one-time digital purchases or custom orders. Nothing on this website should be interpreted as granting ongoing platform access, recurring service rights, or subscription entitlements unless expressly offered.

4. Product nature and limitations

CyberCluster datasets may include structured fields such as domain, status, HTTP status, title, ads score, ads confidence, signals, or related enrichment fields. These fields may rely on automated collection, classification, inference, and processing methods. We do not represent that any dataset is complete, error-free, current at all times, or fit for every specific buyer objective.

5. No guarantee of results

CyberCluster does not guarantee commercial outcomes, outreach performance, reply rates, campaign performance, sales results, hiring outcomes, or any other business result from the use of the data. The data is provided as a business intelligence input, not as a guarantee of performance.

6. Orders, payment, and delivery

Orders are confirmed when payment is successfully processed or when a custom order is accepted in writing. Digital products are delivered electronically, including by email attachment, secure download link, or another electronic delivery method stated at checkout or agreed for a custom order.

  • Prices are those shown at checkout or agreed in writing for custom orders.
  • No recurring billing applies unless explicitly stated.
  • Delivery timing is estimated unless a specific deadline is expressly agreed in writing.

7. Custom orders

For custom dataset work, the agreed scope, filters, enrichment criteria, format, pricing, and estimated delivery terms will be defined before payment where applicable. Changes requested after work has materially started may require revised pricing or timing.

8. Service restrictions and termination

This license automatically terminates if you violate these Terms. CyberCluster may suspend access to the website, cancel undelivered orders, refuse service, or terminate your license where we reasonably believe that misuse, fraud, chargeback abuse, legal risk, or a breach of these Terms has occurred. If the termination results from your breach, you will not be entitled to a refund except where required by law.

9. Intellectual property

The website, branding, design, written content, sample layouts, supporting materials, and the methods used to generate CyberCluster data remain our property or the property of our licensors. Purchase of a dataset does not transfer ownership of our software, pipelines, methods, branding, or website materials.

10. Disclaimer

The website, datasets, previews, and related materials are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, CyberCluster disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

11. Limitations of liability

To the maximum extent permitted by law, CyberCluster shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, business opportunity, goodwill, or data, arising from or related to use of the website, the data, or any deliverable, even if CyberCluster has been advised of the possibility of such damages.

To the maximum extent permitted by law, CyberCluster’s total liability in connection with a specific order shall not exceed the amount paid by the customer for that order.

12. Revisions and updates

Materials appearing on the website may include technical, typographical, or descriptive errors. CyberCluster may change the website, product descriptions, legal terms, or other materials at any time without prior notice. By continuing to use the website after an update, you agree to the then-current version of these Terms.

13. Entire agreement

These Terms, together with the Privacy Policy and Refund Policy on this page, constitute the entire agreement between you and CyberCluster regarding use of the website and purchase of standard website-listed products, unless separate written custom order terms apply.

14. Governing law

These Terms are governed by the laws of [Governing law jurisdiction placeholder]. Any dispute arising out of or relating to these Terms or use of the website shall be subject to the exclusive jurisdiction of the courts located in [Court jurisdiction placeholder], except where applicable law requires otherwise.

Privacy Policy

This Privacy Policy explains how CyberCluster collects, uses, and shares information when you visit this website, contact us, request a custom dataset, or purchase a product.

1. Summary

  • We collect a limited amount of information necessary to operate the website, respond to inquiries, process payments, and deliver digital products.
  • We do not sell your personal information to advertisers.
  • We may use trusted third-party providers for hosting, analytics, payment processing, email delivery, and fraud prevention.
  • We may collect limited technical data such as IP address, browser information, and site usage information.

2. Information you provide directly

Depending on how you interact with the website, we may collect information you provide directly, including:

  • Name
  • Email address
  • Company name
  • Billing details or purchase-related details
  • Messages sent through forms or directly by email

We use this information to respond to your inquiry, process a transaction, provide delivery, issue receipts, handle support, and maintain commercial records.

3. Payment processing

Payments are typically processed by a third-party payment provider such as Stripe or another payment processor selected by CyberCluster. We do not need to store your full payment card details on our own servers in order to complete a standard purchase.

4. Technical and indirect data collection

When you use the website, we may collect technical information such as your IP address, browser type, device information, pages visited, timestamps, referring pages, and basic usage diagnostics. This information may be collected through web server logs, analytics tools, cookies, or similar technologies.

5. Cookies and similar technologies

We may use cookies or similar technologies to keep the website functional, understand traffic patterns, improve the website, detect abuse, and support payment or security workflows. You may be able to manage certain cookie settings through your browser.

6. How we use personal information

  • To operate, secure, and improve the website
  • To respond to support or sales inquiries
  • To process orders and deliver purchased products
  • To send transactional communications such as receipts or delivery messages
  • To detect fraud, abuse, or unauthorized activity
  • To comply with legal, accounting, tax, or regulatory obligations

7. Third-party service providers

We may share information with a limited number of trusted providers where necessary to operate the website and business. These may include:

  • Hosting or infrastructure providers
  • Payment processors
  • Email delivery providers
  • Analytics or fraud-prevention providers
  • Professional advisers such as accountants or legal advisers

We may also disclose information where required by law, legal process, or to protect our rights, customers, website, or business operations.

8. Data center and international transfers

Your information may be processed in the United States or other countries where our service providers operate. By using the website or purchasing from us, you understand that your information may be transferred to and processed outside your home jurisdiction, subject to applicable legal safeguards where required.

9. Data retention

We retain personal information for as long as reasonably necessary to operate the website, complete transactions, maintain business and tax records, resolve disputes, prevent fraud, and comply with legal obligations.

10. Security

We use commercially reasonable technical and organizational measures to protect personal information. However, no internet transmission or storage system is completely secure, and we cannot guarantee absolute security.

11. Your rights

Depending on your jurisdiction, you may have rights to request access to, correction of, deletion of, restriction of, or objection to certain processing of your personal information. To make a request, contact us at data@cyber-cluster.com.

12. Third-party data provider context

CyberCluster may compile and sell datasets derived from publicly accessible business-related web information and technical signals. Our products are intended to concern businesses, ecommerce stores, and commercial websites rather than private or highly sensitive personal profiles. Where we process public business information for dataset creation, we do so as part of a B2B data and market intelligence activity.

We do not claim that all information in our datasets is personal data, and much of it may be non-personal or business-context information such as company domain names, website titles, technical stack indicators, and advertising-related signals. Where a valid removal or legal objection request is received and applicable law requires action, we will review the request in good faith.

13. Data sources and crawling approach

CyberCluster may use automated systems to examine publicly accessible online pages and technical resources for lawful business intelligence purposes. We aim to collect information that is publicly available or technically observable from public-facing web resources. We do not state on this page that every possible industry standard or crawler instruction is honored in every context, so do not add claims here unless you are actually enforcing them consistently.

14. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, providers, operations, or legal requirements. The version posted on this page is the current version.

15. Contact

For privacy-related questions, requests, or complaints, contact data@cyber-cluster.com.

Refund Policy

Thank you for choosing CyberCluster. We aim to provide clear product descriptions and professionally delivered digital datasets. Because our products are digital and can be used immediately after delivery, refund eligibility is limited.

1. Refund eligibility

Standard digital dataset purchases are generally final once the product has been delivered by email, secure download link, or another electronic method. However, a refund may be considered in the following cases:

  • If you request cancellation before delivery and work has not materially started.
  • If the delivered product materially differs from the product description shown at checkout or from an expressly agreed custom scope.

2. Refund window for delivery issues

If you believe the delivered product materially differs from its description, you must contact CyberCluster within 7 calendar days of delivery. Your request must include your name, purchase email, order details, and a clear explanation of the issue.

3. Refund process

To request a refund or raise a delivery issue, contact data@cyber-cluster.com and provide:

  • Your full name
  • Email address used for the order
  • Date of purchase
  • Order reference if available
  • Reason for the request

If a refund is approved, it will generally be processed using the same payment method used for the original purchase, unless otherwise agreed.

4. Non-eligible grounds for refund

  • Requests made after the stated refund window for a material mismatch claim
  • Change of mind after delivery
  • Lack of desired commercial results, outreach results, or business performance
  • Failure to review the product description before purchase
  • Minor variances that do not materially change the nature of the product
  • Violation of our Terms of Service or abusive use of the website or data

5. Remedy options

If CyberCluster confirms that the delivered product materially differs from what was described, we may choose, at our discretion, to provide a corrected delivery, replacement file, partial refund, or full refund depending on the circumstances.

6. Effect of refund

If a refund is issued, your license to use the refunded product terminates immediately. You must stop using the data and delete any refunded files or copies in your possession, except where retention is required by law.

7. Chargebacks

You agree to contact CyberCluster first to attempt resolution before initiating a chargeback or payment dispute, unless prohibited by law. We reserve the right to provide delivery records, communications, and relevant order information to payment processors when responding to disputes.

8. Contact us

If you have questions about this Refund Policy, contact data@cyber-cluster.com.

This Refund Policy does not exclude any mandatory rights that apply under governing law.
